Terms of sale

1. Purpose and parties

These terms govern the distance sale, through playtesterhub.com, of Google Play closed testing services provided by [À COMPLÉTER : raison sociale], [À COMPLÉTER : adresse du siège], [À COMPLÉTER : SIREN / RCS] ("PlayTesterHub") to any customer, consumer or business ("the Customer").

Consumer-specific provisions (including the right of withdrawal and mediation) do not apply to business Customers, except where the law extends them.

2. Services

Tests are carried out by the PlayTesterHub team on 12 physical Android devices managed in-house, in France. Three plans are available, all with 12 testers opted in for 14 days, testers located in France:

• Standard — €15 incl. VAT: Google Play closed test with 12 testers opted in for 14 days, testers located in France, with real-time progress tracking in the customer area (dashboard).
• Premium — €25 incl. VAT: the Standard service, plus an end-of-test report including advice and recommendations.
• Premium+ — €40 incl. VAT: the Premium service, plus screenshots taken on our test devices with descriptions, a daily report for the duration of the test, and the final report.

The service consists of opting our testers into the Customer's closed test and keeping them opted in for 14 days, to help meet Google Play's testing requirement. PlayTesterHub does not post, and never promises, any review or rating on the Play Store.

3. Prices

Prices are in euros, including all taxes. [À COMPLÉTER : régime TVA — TVA applicable ou « TVA non applicable, art. 293 B du CGI »]. The applicable price is the one displayed when the order is confirmed.

4. Ordering and payment

The Customer selects a plan, fills in the requested information and pays online. Payment is processed by Stripe; PlayTesterHub never has access to full card details and does not store them. The order is final once payment is confirmed; a summary is available in the Customer's dashboard.

5. Timing

Testing starts within 48 hours of receiving your opt-in link, provided the obligations in section 6 are met. The test lasts 14 days with 12 testers opted in.

6. Customer obligations

For the service to be performed, the Customer agrees to:

• publish a closed testing track in the Google Play Console;
• include France in the countries targeted by that track;
• provide the test opt-in link;
• provide a feedback URL or email address for the test;
• provide test credentials if the app requires signing in;
• offer a free app (no paid apps);
• not add our testers' accounts to internal testing;
• not pause or delete the testing track during the 14 days;
• keep the testers opted in until the production access request has been submitted.

Failure to meet these obligations may delay or prevent the service, and PlayTesterHub cannot be held liable for it. See the exclusions in our refund policy.

7. No guarantee of Google approval

We do not guarantee Google's approval. Google alone decides on production access and may change its requirements at any time. PlayTesterHub commits to running the test (12 testers opted in for 14 days), not to Google's decision. PlayTesterHub provides no reviews or ratings on the Play Store.

8. Right of withdrawal (consumers)

Under article L221-18 of the French Consumer Code, consumer Customers have 14 days from the conclusion of the contract to withdraw, without giving any reason.

Exception (article L221-28 1°): the right of withdrawal cannot be exercised once the service has been fully performed before the end of the withdrawal period, where performance began with the consumer's prior express consent and express waiver of their right of withdrawal.

If the consumer expressly asked for the service to begin before the end of the withdrawal period and then withdraws, they owe an amount proportionate to what was provided until they communicated their decision to withdraw (article L221-25). Any remaining amount is refunded within 14 days, using the same payment method.

9. Free re-runs and refunds

Free re-runs, refunds, exclusions and how to request them are described in our refund policy, which forms part of these terms.

10. Liability

PlayTesterHub has an obligation of means. Except in case of gross negligence or wilful misconduct, and without prejudice to consumers' statutory rights, its liability is limited to the price paid for the order concerned. PlayTesterHub is not liable for Google's decisions or for the consequences of the Customer failing to meet its obligations.

11. Personal data

Data needed for the order is processed in accordance with our privacy policy.

12. Complaints and consumer mediation

Complaints can be sent to [email protected]. If a dispute is not resolved, consumer Customers may use the consumer mediator free of charge: [À COMPLÉTER : médiateur de la consommation].

13. Governing law

These terms are governed by French law. Failing an amicable settlement, disputes are brought before the competent courts; consumers keep the benefit of the protective jurisdiction rules provided by law.
